Car accidents are a common occurrence in the state of New York and can have devastating consequences for those involved. To protect yourself and others on the road, it is crucial to understand the most common causes of car accidents and what the law requires of drivers.

Key takeaways

  • Distracted driving, speeding, drunk driving, fatigue and bad weather are among the most common causes of car accidents in New York.

  • New York bans using a handheld device while driving, and violators can face fines and points on their licenses.

  • If you feel too tired to drive, pull over and rest before continuing your trip.

  • A driver who breaks a traffic law may be found negligent, but the other person's own conduct can still affect how fault is shared.

  • If you have been in a car accident, talk with an attorney who can explain your rights.

Distracted Driving- Distracted driving is one of the leading causes of car accidents in New York and refers to any activity that takes a driver's attention away from the road. This can include texting, eating, grooming, and more. Under New York law, using a handheld device while driving is illegal, and violators can face hefty fines and points on their licenses.

Speeding- Speeding is a significant factor in many car accidents, and New York has strict laws regulating speed on the road. Exceeding the posted speed limit or driving too fast for conditions can result in fines, points on your license, and even jail time in extreme cases. Speed can also come up when a court decides fault. In Orellana v. Mendez, 208 A.D.3d 888 (2d Dep't 2022), a driver who failed to yield at a stop sign was found negligent as a matter of law. The court explained that his speculative claim that the other driver was speeding "would speak to the plaintiff's comparative fault, not the defendant's liability."

Drunk Driving - Driving under the influence of alcohol or drugs is a serious crime in New York and is one of the leading causes of car accidents. If you are found to have a blood alcohol content of .08% or higher, you can face serious penalties, including fines, license suspension, and jail time.

Reckless Driving- Reckless driving refers to any behavior that endangers the lives of others on the road, such as running red lights, tailgating, and more. Reckless drivers can face criminal charges, fines, and points on their licenses. Breaking traffic rules also matters in a civil injury claim. In Liying Qian v. Eggens, 2026 NY Slip Op 00244 (2d Dep't 2026), a driver who conceded making a prohibited left turn, and who failed to use due care toward a pedestrian, was found negligent as a matter of law. Whether the pedestrian was outside the crosswalk was a separate question about her own share of the fault.

Fatigue- Drowsy driving can be just as dangerous as drunk driving and is a leading cause of car accidents in New York. If you feel too tired to drive, it is important to pull over and rest before continuing your journey.

Weather Conditions - Inclement weather can make driving conditions dangerous, and it is essential to adjust your driving behavior accordingly. In New York, drivers must use caution in wet, snowy, or icy conditions and slow down if visibility is reduced.

Defective Vehicles - Defective vehicles can also contribute to car accidents, and New York law requires all vehicles to be in good working condition. If you believe that a defect in your vehicle may have contributed to an accident, you may be able to seek compensation from the manufacturer.

Roadway Design- Defects Sometimes, car accidents are the result of defects in the roadway itself. In these cases, the government or a contractor may be responsible for the accident.

Aggressive Driving - Aggressive driving, such as tailgating, cutting off other drivers, and making illegal lane changes, can increase the risk of car accidents. In New York, aggressive driving can result in fines and points on your license. An unsafe lane change can also decide fault in a lawsuit. In Munoz-Rosario v. Padilla, 2025 NY Slip Op 02010 (1st Dep't 2025), the court held that a driver who admittedly changed lanes unsafely was negligent per se under the Vehicle and Traffic Law. His vague affidavit blaming a third vehicle he had not mentioned before did not raise a fact issue.

Inexperience - Inexperienced drivers, such as teens or newly licensed drivers, are more likely to be involved in car accidents due to their lack of experience on the road. In New York, there are strict licensing requirements in place to help ensure that new drivers are equipped with the skills and knowledge they need to operate a vehicle safely.

Whatever caused the crash, something we see again and again is that a strong case comes down to three things: a real injury, real treatment, and real effects on your life, such as missing work or no longer being able to do the things you need to do or love to do.

In conclusion, by understanding the most common causes of car accidents and following the laws in place to protect drivers, you can help to reduce the risk of car accidents in New York. If you have been involved in a car accident, it is important to seek the advice of an experienced attorney who can help you understand your rights and protect your interests.
