If you have been injured in New York City, one of the first questions on your mind is probably: what is my case actually worth? It is a fair question, and it does not have a simple answer. Every case is different. But looking at real verdict and settlement data from 2025 and 2026 gives you a concrete picture of what juries and insurance companies are paying for different types of injuries in New York courts right now.

This post breaks down recent verdicts and settlements by case type, explains why New York numbers are so much higher than the national average, and shows you the factors that drive case value up or down.

How Much Are Personal Injury Cases Worth in New York Compared to the Rest of the Country?

New York personal injury cases are worth significantly more than cases in most other states. The median compensatory damages award for personal injury trials in New York is $287,628. The national median is just $34,550. That means New York cases pay out more than eight times the national figure.

Within New York, location matters even more. Cases filed in Manhattan or Brooklyn receive settlement offers that average 28 percent higher than identical cases filed in upstate venues. The Bronx and Manhattan tend to produce the most substantial verdicts, while Staten Island is comparatively more conservative.

Why the difference? Higher medical costs, higher wages, higher cost of living, and juries that are more willing to hold defendants accountable. New York also has no caps on non-economic damages like pain and suffering. Unlike states such as California or Texas that limit what juries can award, New York juries can award whatever they believe is appropriate.

What Are the Largest Recent Personal Injury Verdicts in New York?

Several verdicts from 2025 and recent years illustrate the range of what New York juries are willing to award.

In April 2025, a Nassau County jury returned a $60,033,041 verdict in the case of Gangaram v. Pain Institute of Long Island. David Gangaram, a 65-year-old electrical mechanic from Valley Stream, went in for a routine lumbar epidural steroid injection. Within minutes of waking from sedation, he suffered a massive spinal cord infarction that left him permanently paralyzed. The trial team presented spinal angiogram imaging and expert testimony showing that a high-risk medication, not documented in the medical record, was likely used. After a three-week trial, the jury deliberated for less than three hours before returning a unanimous verdict. It is believed to be the largest medical malpractice verdict in Nassau County history.

In the Reilly v. St. Charles Hospital case, a Suffolk County jury awarded $130 million to the family of Shannon Reilly, a child who developed cerebral palsy after being deprived of oxygen during delivery. The hospital had offered $8 million before the first trial. The family rejected the offer, lost the first trial, won on appeal, faced a second mistrial, and finally won $130 million at a third trial. It stands as one of the largest medical malpractice verdicts in New York State history.

In January 2026, a Westchester County jury awarded $8 million against the City of Yonkers after a Department of Public Works truck struck a driver parked on Ashburton Avenue. The jury awarded $2 million for past pain and suffering, $4.5 million for future pain and suffering, and $1.5 million for future medical expenses. The plaintiff described injuries to his neck, left shoulder, lower back, and left knee with lasting pain and physical limitations.

How Much Are Car Accident Settlements Worth in NYC?

The average car accident settlement in New York is approximately $287,000, compared to the national average of about $30,416. But that average covers a wide range depending on injury severity.

Here is how car accident settlement values typically break down in New York:

  • Minor injuries (soft tissue, whiplash): $3,000 to $25,000

  • Moderate injuries (fractures, herniated discs): $25,000 to $100,000

  • Severe injuries (traumatic brain injury, spinal damage): $100,000 to $1,000,000 or more

  • Catastrophic or permanent disability: $1,000,000 to $5,000,000 or more

Keep in mind that New York is a no-fault state. Your own insurance company is required to pay up to $50,000 for economic and medical losses regardless of who caused the accident. But no-fault insurance does not cover pain and suffering. To recover damages beyond the $50,000 no-fault threshold, you must show that you suffered a "serious injury" as defined by Insurance Law Section 5102(d). That includes permanent loss of a body organ or function, significant disfigurement, fractures, or injuries that substantially limit your ability to perform daily activities for at least 90 of the first 180 days after the accident.

The same herniated disc injury requiring surgery might settle for $180,000 in Syracuse but command $265,000 in Manhattan. Clear video or photographic evidence increases settlement values by roughly 35 percent, and plaintiffs who seek treatment within 24 hours of injury receive settlements that are approximately 40 percent higher than those with gaps in treatment.

What Is Medical Malpractice Worth in New York?

New York leads the nation in medical malpractice payouts. In 2025, total medical malpractice payouts across the state reached $729.58 million, up from $595.42 million in 2024. The average payout per claim is approximately $464,000, well above the national average of about $242,000.

Over 96 percent of medical malpractice claims in New York are resolved through settlement rather than trial. Most settlement amounts fall between $100,000 and $249,999. But the cases that go to trial can produce dramatically larger results.

Pediatric malpractice cases, particularly birth injury claims involving cerebral palsy or brain damage, produce especially high awards. The average settlement in pediatric malpractice cases is $562,180 when an indemnity payment is made. But as the Reilly case shows, jury verdicts in these cases can reach nine figures.

The absence of damage caps in New York is a critical factor. States that cap non-economic damages artificially limit what injured patients can recover. New York does not impose those limits, which means juries evaluate each case on its merits and award what they believe is fair.

How Much Do Construction Accident Cases Pay in New York?

New York has some of the strongest worker protection laws in the country, and construction accident cases reflect that. Labor Law Section 240, commonly known as the Scaffold Law, imposes absolute liability on property owners and general contractors for gravity-related injuries. If a construction worker falls from a height or is struck by a falling object because proper safety equipment was not provided, the owner and general contractor are liable regardless of the worker's own conduct.

This strict liability standard drives construction accident verdicts and settlements significantly higher than in states without similar laws. Scaffold fall cases with permanent back injuries regularly settle in the range of $2 million to $15 million, depending on the severity of the injury and the venue.

The Tribeca crane collapse settlement of $272.5 million stands as the largest construction accident recovery in New York history. That case arose from the February 2016 collapse of a 565-foot crawler crane on Worth Street, which killed one motorist and injured three others. The crane, owned by Bay Crane and operated by Galasso Trucking and Rigging, toppled after the operator failed to secure it the night before and lowered the boom at an improper angle the next morning.

Manhattan and Brooklyn venues tend to produce higher construction accident verdicts than the outer boroughs, with Manhattan cases often yielding payouts 15 to 20 percent above the citywide average.

How Much Does New York City Pay in Tort Claim Settlements Each Year?

If your injury was caused by a City of New York employee or agency, the numbers are staggering. In fiscal year 2024, New York City paid out $1.04 billion in personal injury and property damage tort claims. The city paid nearly $2 billion total across all claim types.

The five agencies with the highest tort settlement costs were the NYPD ($309.56 million), Department of Correction ($252.87 million), Department of Education ($128.07 million), Department of Transportation ($115.27 million), and Health + Hospitals ($45.77 million).

Auto accident claims against the city totaled $125.68 million. Claims against the NYPD increased by 30.7 percent, with 9,036 claims filed in fiscal year 2024 alone.

These numbers matter because they show that the City of New York routinely pays substantial sums to settle personal injury claims. If you were injured by a city vehicle, on a city-maintained sidewalk, or in a city facility, there is a well-established process for recovering damages, though you must file a notice of claim within 90 days of the incident under General Municipal Law Section 50-e.

What Factors Drive Personal Injury Case Value Up or Down in NYC?

Several factors consistently affect how much a personal injury case is worth in New York City.

Injury severity is the single biggest factor. Permanent injuries, surgeries, and ongoing treatment needs push values up significantly. A herniated disc requiring surgery is worth far more than one treated conservatively.

Speed of treatment matters more than most people realize. Plaintiffs who seek medical attention within 24 hours of an accident receive settlements that are approximately 40 percent higher than those who delay. Insurance companies use treatment gaps to argue that your injuries are not serious.

Evidence quality is another major driver. Clear video or photographic evidence of the accident increases settlement values by about 35 percent and leads to faster resolution.

Expert testimony can dramatically increase case value. Lost earning capacity claims supported by vocational expert testimony produce settlements that are roughly 60 percent higher than cases without that documentation.

Venue plays a significant role. The Bronx and Manhattan are known for the largest verdicts in the state. Cases filed in these boroughs settle for more than similar cases in other jurisdictions simply because defendants know what juries there are willing to award.
